Important – Beta Phase Only
This document applies exclusively to beta testers participating in the pre-launch testing of 5X Wingman via TestFlight (or similar internal testing channels). By installing, accessing, or using this beta version, you agree to these Beta Terms of Service ("Terms") and Privacy Policy. This version does not apply to the future public release of the App. Upon public launch, a separate, updated Terms of Service and Privacy Policy will be presented to all users during account creation or first use. If you do not agree to these Beta Terms, do not install or use the beta App.
Welcome to 5X Wingman ("the App"), a mobile application for pilot schedule tracking. By participating in this beta test, you agree to these Terms and our Privacy Policy.
The App is for personal, non-commercial beta testing use by eligible IPA pilots only.
Features include schedule/roster tracking, parking spot navigation, layover reviews, crew management, user-to-user sharing, and export (e.g., PDFs/images).
You grant us a license to store, process, and display your uploaded/generated data solely to provide the beta service and collect feedback.
Prohibited: Unauthorized sharing of data outside the App or testing group, reverse engineering, hacking, or any illegal use.
5X Wingman is an informational tool only and is not FAA-certified, approved, or endorsed. It does not replace official airline schedules, logbooks, or regulatory requirements under Federal Aviation Regulations (FARs), including 14 CFR Parts 121 and 117 duty and rest requirements. You are solely responsible for compliance with all applicable laws, airline policies, IPA rules, and safety standards. We disclaim any liability for errors, omissions, inaccuracies in parsed data (e.g., from forwarded emails), or reliance on the App that leads to regulatory violations, fatigue, incidents, or any harm. Use at your own risk.
5X Wingman is an independent application developed by a third party and is not affiliated with, endorsed by, sponsored by, or in any way part of United Parcel Service Co. (UPS) or the Independent Pilots Association (IPA). Any references to UPS or IPA are for informational purposes only, and users should not infer any official connection or approval from these entities. The App is not an official tool of any airline or pilot association, and its use does not imply compliance with or exemption from any organizational policies.
The App, code, design, and content are owned by 5X Wingman. You retain ownership of your uploaded data but grant us a worldwide, royalty-free license to use, store, and process it for beta service provision, improvements, feedback analysis, and backups.
We may suspend or terminate your beta access at any time, including for violations (e.g., unauthorized sharing, non-IPA use), inactivity, or denial of approval.
Upon termination, your data may be deleted (with possible backups retained for 30 days).
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages.
Total liability is capped at amounts paid by you in the prior 12 months (if any).
Governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflicts of laws.
We are committed to protecting your privacy. This explains our data practices during beta testing.
Data is stored both locally on your device (e.g., via secure local storage for offline access) and in the cloud/backend (Supabase for auth/database, AWS Amplify for hosting/storage if photos enabled).
Shared with trusted third parties under strict contracts:
No selling of personal data. Shared only as needed for beta service, backups, or legal requirements.
We use industry-standard measures (e.g., encryption, hashing) but cannot guarantee absolute security.
Access, update, or delete your data via in-app settings or contact us. Withdraw permissions (e.g., location, contacts) in device settings. Request data export/deletion (we respond within 30 days). For California (CCPA) or EU/international users (GDPR): Additional rights to access, rectify, erase, or restrict data—contact us for requests. Opt-out of non-essential communications.
Retained as long as your beta account is active or needed for service/legal purposes. Deleted upon request, testing end, or account termination (with possible short-term backups).
Data is processed/stored in the US. By using the beta App, you consent to this transfer. We comply with applicable laws (e.g., GDPR for EU users where required).
Not intended for users under 18.
We may update this policy—continued use means acceptance. We will notify significant changes via TestFlight or email.
