Aviation and Safety Disclaimer (Critical)

5X Wingman is an informational tool only. It is not FAA-certified, approved, or endorsed by any airline, the Independent Pilots Association (IPA), or any regulatory authority. The App does not replace official airline schedules, logbooks, crew management systems (CMS/JCT), or any regulatory requirements under Federal Aviation Regulations (FARs), including 14 CFR Parts 121 and 117 duty and rest rules.

You are solely responsible for verifying the accuracy of all data displayed in the App. This includes, but is not limited to, report times, flight times, duty periods, rest requirements, layover durations, deadhead information, contract warnings, pay/credit estimates, live data overlays, Trip Kit exports, and any parsed roster or schedule data. Errors or inaccuracies in the App can have serious professional consequences, including potential violations of duty/rest rules, regulatory infractions, or career-ending outcomes. Always cross-check all information against your official airline sources (e.g., CMS Workschedule or JCT Details page) before relying on it.

Offline data, parsed rosters, live flight information, contract-rule alerts, pay/credit estimates, layover information, and exported documents may be delayed, incomplete, unavailable, or incorrect. Official airline, company, FAA, CMS, JCT, and other authoritative sources always control over anything displayed or generated by the App.

Your use of the App must comply at all times with:

• All applicable laws and regulations, including Federal Aviation Regulations (FARs) and 14 CFR Parts 121 and 117;
• Your airline's Standard Operating Procedures (SOPs), policies, and procedures;
• Company rules and the IPA collective bargaining agreement;
• Any other restrictions on electronic device use during flight or critical phases of operation.

You agree not to use the App in any manner or at any time that is prohibited by law, regulation, airline policy, or safety requirements. We disclaim any liability for any consequences arising from your use (or misuse) of the App in violation of these rules.

5X Wingman is an independent application and is not affiliated with, endorsed by, sponsored by, or part of United Parcel Service Co. (UPS), the Independent Pilots Association (IPA), any airline, the FAA, or any other regulatory authority. References to any airline, union, system, contract, or regulator are for identification and informational purposes only.

1. Eligibility and Accounts

The App is intended exclusively for pilots who are members in good standing with the Independent Pilots Association (IPA). You must be at least 18 years old. Accounts are created via 5xwingman.com with your name, email address, password, and the last 4 digits of your GEMS number for manual eligibility review. New accounts start in "pending" status and require approval before full access. Unauthorized use, including sharing data or access with non-IPA pilots in good standing, is prohibited and may result in immediate account termination. You are responsible for maintaining the confidentiality of your account credentials.

2. Subscriptions and Payments

The App currently offers a single Premium subscription, currently listed at $4.99 per month or $49.99 per year where available. A free trial, including a first month free, may be offered to eligible users at our discretion and is not guaranteed for every user, platform, region, or purchase. Payments, billing, renewals, cancellations, and refunds are handled through the Apple App Store and Google Play, depending on which platform you use. RevenueCat may support subscription and entitlement management. Subscriptions automatically renew unless canceled through your Apple or Google account settings before renewal. Taxes, fees, currency conversion, and platform charges may apply. Prices, trials, features, eligibility, discounts, promo codes, and promotional offers may change, expire, or be limited at any time. Discount or promo code availability, redemption, and continued validity are not guaranteed and may also be subject to Apple, Google, RevenueCat, or other provider terms. Except where required by law or applicable App Store or Google Play policy, payments are non-refundable.

3. Use of the App & User Content

The App is for personal, non-commercial use by eligible IPA pilots only. Features include schedule/roster tracking, parking spot navigation, layover reviews, crew management, user-to-user sharing, family schedule sharing, and export (e.g., PDFs/images).

You grant us a worldwide, royalty-free, non-exclusive license to store, process, display, transmit, and use your uploaded/generated data (including schedules, layover reviews, photos, parking spots, crew/contact entries, and exported content) solely to provide, secure, support, and improve the service.

You are responsible for content you upload, enter, import, forward, review, share, or export through the App. You agree not to submit content that is unlawful, defamatory, harassing, private or confidential without permission, unsafe, infringing, misleading, or otherwise harmful. We may remove content or suspend access if we believe content violates these Terms, creates legal risk, or threatens the security or integrity of the service.

You should only forward roster, schedule, travel, or company emails and data that you are authorized to share with the App. You are responsible for complying with your employer's policies, confidentiality obligations, and applicable law when importing or sharing schedule-related information.

Prohibited Conduct: Unauthorized sharing of data outside the App, reverse engineering, scraping, hacking, interference with service security, commercial use, misuse of another user's account or data, or any illegal use is strictly prohibited.

4. Family, Friend, and User-to-User Sharing

The App may allow you to share selected schedule, trip, live flight, layover, review, or family-facing information with other users or invited family members. You control whom you invite or approve, and you are responsible for making sure each recipient is authorized to receive the information you share.

Family accounts are intended for read-only schedule visibility and related family-facing features. Friend and family sharing may expose timing, trip, flight, layover, and status information to the people you select. Do not invite or share with anyone who should not receive that information, and promptly revoke access if circumstances change.

5. Intellectual Property

The App, code, design, and content are owned by 5X Wingman. You retain ownership of your uploaded data subject to the license above.

6. Termination

We may suspend or terminate accounts at any time, including for violations (e.g., unauthorized sharing, non-IPA use), inactivity, denial of approval, security risk, or legal risk. Upon termination or deletion request, active data may be deleted, while backups, logs, fraud-prevention records, legal records, or security records may be retained for a limited period where reasonably necessary.

7. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied. We do not warrant that the App will be error-free, accurate, or uninterrupted.

8. Indemnification

You agree to indemnify and hold harmless 5X Wingman, its owners, and affiliates from any claims, damages, or liabilities arising from your use of the App, your violation of these Terms, or your violation of any law, regulation, or airline policy.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages. Total liability is capped at amounts paid by you in the prior 12 months.

10. Modifications to Terms

We may update these Terms. Continued use after changes means acceptance. We will notify you of material changes via the App or email.

11. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflicts of laws. Unless applicable law requires otherwise, any dispute that cannot be resolved informally will be brought in the state or federal courts located in Kentucky, and you consent to personal jurisdiction and venue there.
