5X Wingman Terms of Service and Privacy Policy

Welcome to 5X Wingman ("the App"), a mobile application for pilot schedule tracking and layover tools. By creating an account, accessing, or using the App or 5xwingman.com, you agree to the current Terms of Service and Privacy Policy. If you do not agree, do not use the App or website.
Aviation and Safety Disclaimer (Critical)
5X Wingman is an informational tool only. It is not FAA-certified, approved, or endorsed by any airline, the Independent Pilots Association (IPA), or any regulatory authority. The App does not replace official airline schedules, logbooks, crew management systems (CMS/JCT), or any regulatory requirements under Federal Aviation Regulations (FARs), including 14 CFR Parts 121 and 117 duty and rest rules.
You are solely responsible for verifying the accuracy of all data displayed in the App. This includes report times, flight times, duty periods, rest requirements, layover durations, deadhead information, contract warnings, pay/credit estimates, live data overlays, Trip Kit exports, and any parsed roster or schedule data. Always cross-check all information against your official airline sources before relying on it.
5X Wingman is independent and is not affiliated with, endorsed by, sponsored by, or part of UPS, IPA, any airline, the FAA, or any other regulatory authority. Official airline, company, FAA, CMS, JCT, and other authoritative sources always control over anything displayed or generated by the App.
1. Eligibility and Accounts
- The App is intended exclusively for pilots who are members in good standing with the Independent Pilots Association (IPA).
- You must be at least 18 years old.
- Accounts are created via 5xwingman.com with your name, email address, password, and last four digits of your GEMS number. New accounts start in "pending" status and require approval before full access.
- Unauthorized use, including sharing data or access with non-IPA pilots in good standing, is prohibited and may result in immediate account termination.
- You are responsible for maintaining the confidentiality of your account credentials.
2. Subscriptions and Payments
The App currently offers a single Premium subscription. Payments, billing, renewals, cancellations, and refunds are handled through the Apple App Store and Google Play, depending on which platform you use. RevenueCat may support subscription and entitlement management. Prices, trials, features, eligibility, discounts, promo codes, and promotional offers may change, expire, or be limited at any time.
3. Use of the App and User Content
The App is for personal, non-commercial use by eligible IPA pilots only. Features include schedule/roster tracking, parking spot navigation, layover reviews, crew management, user-to-user sharing, family schedule sharing, and export. You grant us a worldwide, royalty-free, non-exclusive license to store, process, display, transmit, and use your uploaded/generated data solely to provide, secure, support, and improve the service. Unauthorized sharing, reverse engineering, hacking, commercial use, or illegal use is prohibited.
You should only forward roster, schedule, travel, or company emails and data that you are authorized to share with the App. You are responsible for content you upload, import, share, or export, and we may remove content or suspend access when needed to address legal, safety, or security risk.
4. Family, Friend, and User-to-User Sharing
The App may allow you to share selected schedule, trip, live flight, layover, review, or family-facing information with other users or invited family members. You control whom you invite or approve and are responsible for making sure each recipient is authorized to receive the information you share.
5. Intellectual Property
The App, code, design, and content are owned by 5X Wingman. You retain ownership of your uploaded data subject to the license above.
6. Termination
We may suspend or terminate accounts at any time, including for violations, unauthorized sharing, non-IPA use, inactivity, denial of approval, security risk, or legal risk. Upon termination or deletion request, active data may be deleted, while backups, logs, fraud-prevention records, legal records, or security records may be retained for a limited period where reasonably necessary.
7. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, accurate, or uninterrupted.
8. Indemnification
You agree to indemnify and hold harmless 5X Wingman, its owners, and affiliates from any claims, damages, or liabilities arising from your use of the App, your violation of these Terms, or your violation of any law, regulation, or airline policy.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages. Total liability is capped at amounts paid by you in the prior 12 months.
10. Modifications to Terms
We may update these Terms. Continued use after changes means acceptance. We will notify you of material changes via the App or email.
11. Governing Law and Venue
Governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflicts of laws. Unless applicable law requires otherwise, disputes that cannot be resolved informally will be brought in state or federal courts located in Kentucky.
Privacy Policy Summary
We collect and process information needed to provide the App and website, including account/profile data, schedule and roster data, family/friend sharing settings, crew/contact data you provide, location data with permission, device and usage data, forwarded roster email data, and photo/media data you choose to use with App features.
How We Use Data: To provide core features, parse and import roster data from emails you forward, manage accounts, invites, and subscriptions, maintain security, support offline functionality, and improve the service. We do not use your data for advertising or to track you across other apps or websites.
Data Storage and Sharing: Data is stored locally on your device and in the cloud. We share data only with trusted service providers as necessary, including Supabase, Resend.com, AWS Amplify, RevenueCat, Apple, and Google. We do not sell personal data.
Friend and Family Sharing: Selected schedule, trip, live flight, layover, review, or family-facing information may be shared with users or family members you invite or approve.
Your Choices and Rights: You may access, update, export, or delete data through App settings where available or by contacting us. You may withdraw device permissions in system settings.
